Your Questions Answered About The Fields Of Law

Hello, my name is Susan Farris and my hobby is learning about the law. I have an uncle who is an attorney and I've always looked up to him and that's why I find subjects on law very interesting. Through speaking with my uncle and doing research on my own, I've learned about all the different fields of law. Each field of law centers on its own subject and most attorneys specialize in a certain area of law. These include criminal, personal injury, family, bankruptcy, criminal, immigration and business. I find each one of these fields very interesting and I have the utmost admiration for lawyers because they help people through their legal struggles. I wanted to share this information with others who have questions about the different types of attorneys and the law.

Who Needs An Estate Planning Attorney?

Many people can benefit from hiring an estate planning attorney to help write their will and create a plan for their estate upon their death. However, not everyone needs this service. You may therefore be unsure of whether hiring an estate planning attorney is something you should do. Here are some signs that you could really benefit from this service.

You own a business.

If you own a business, you should absolutely work with an estate planning lawyer. They can help you create a plan for passing on your business to a family member, partner, or other designated individual. Or, they can make sure it is legally specified that the business will be dissolved and the funds dispersed upon your death if that's what you'd prefer. Without an estate plan, assets in a business can be tied up for years before a spouse or children are able to access them. A lawyer can ensure prompt access to these funds.

You want to pass your money on to a nonrelative.

Your children are typically your legal heirs. Upon your death, your assets will be passed on to them. If you would rather your assets be left to someone else, such as a friend, a romantic partner, or a business partner, then you need to hire an estate planning attorney. They'll file the documents to override your state's usual inheritance process and ensure your assets are left to the proper parties.

You own a lot of property.

The more property you own, the more complicated your will becomes. If you own several rental properties, for instance, you will need a will that specifies who each one goes to, whether the renters will be able to continue to rent, and so forth. An estate planning lawyer will ensure this is all written up seamlessly.

You have young children.

If your children are young enough that they would require a guardian if you were to pass away, then you should absolutely hire an estate planning attorney. The attorney will make sure your children are put under the guardianship of your chosen adult or adults. This is especially important if you do not want your children to end up with their grandparents, who are often the adults the courts would leave them with by default.

If you are in any of the situations above, make sure you work with an estate planning attorney to write up an airtight will. Contact a local estate attorney to learn more.
