Hello, my name is Susan Farris and my hobby is learning about the law. I have an uncle who is an attorney and I've always looked up to him and that's why I find subjects on law very interesting. Through speaking with my uncle and doing research on my own, I've learned about all the different fields of law. Each field of law centers on its own subject and most attorneys specialize in a certain area of law. These include criminal, personal injury, family, bankruptcy, criminal, immigration and business. I find each one of these fields very interesting and I have the utmost admiration for lawyers because they help people through their legal struggles. I wanted to share this information with others who have questions about the different types of attorneys and the law.
If you go into the hospital for a routine medical procedure and you come out much worse than when you entered, there could be medical negligence at play. While there are times when you can experience a complication from treatment that was administered correctly, an attorney will look at your injuries and the treatment you received throughout to see if there was any reason to believe your care was negligent. You will need to provide your entire medical record, including any testing that was done before you entered the hospital for the procedure in question. You will also want to have your records from the treatment you have received since your injury.
Your Level of Function before the Medical Procedure
In order to prove that you are injured because of negligence, you'll have to be able to show that you have suffered damages from the treatment you received. For example, if you have a bad knee before the procedure and your knee is the same once it is over, you haven't suffered any damages. While you might have expected your knee to be better from the treatment, having your knee the same doesn't prove negligence.
Standards of Care
When you are looking at filing a case for medical negligence, the success of your case is going to hinge on the care you received. If your treatment providers did exactly what was expected of them, there wasn't negligence. If the care was standard, meaning most other doctors would have done the same thing, there isn't negligence. On the other hand, if it is determined that your doctor didn't follow the standard care and you were hurt because of it, this is what medical negligence is all about.
Proving Your Injuries
Proving injuries in any personal injury lawsuit requires treatment with a variety of medical providers. You will want to show that you are compliant with treatment and that you are trying to heal from your injuries. If you don't go to treatment, you won't have anyone that will be able to talk about your injuries. When you seek treatment, your providers will have documentation that describes your injuries and how well you are doing in care.
