Hello, my name is Susan Farris and my hobby is learning about the law. I have an uncle who is an attorney and I've always looked up to him and that's why I find subjects on law very interesting. Through speaking with my uncle and doing research on my own, I've learned about all the different fields of law. Each field of law centers on its own subject and most attorneys specialize in a certain area of law. These include criminal, personal injury, family, bankruptcy, criminal, immigration and business. I find each one of these fields very interesting and I have the utmost admiration for lawyers because they help people through their legal struggles. I wanted to share this information with others who have questions about the different types of attorneys and the law.
If you have a medical malpractice case that includes a birth injury, the first thing that you need to do is find an attorney to represent you. Then, you need to make sure that you file a medical malpractice case with the courts before the deadline to file a case passes. Once you have a court date set, there are a couple of things that you and your attorney need to work on in order to win your case.
1. Show That the Doctor Was Negligent
One of the hardest parts of your cases is not showing that you received poor medical care, it is showing that the medical care that you receive was negligent. Showing that the medical care that you got was negligent is the tricky part of winning your case.
You need to not only show the doctor's actions, you need to show that your doctor should have made different actions. To show that any informed doctor would have made different actions, you need to have a few different doctors who practice the same type of medicine review your case. You need to find a doctor or doctors who will testify on the stand that the doctor's actions were not just different than they might make, but were harmful to your care and against good medical sense and advice for any practicing doctor.
2. Get the Jury on Your Side
It is not enough to prove that the doctor's actions were negligent, you also need to be able to get the jury on your side. This is where hiring a skilled medical malpractice attorney to help you with your case. You need an attorney who will help you build your case and tell your story. You need an attorney who will tell a story and paint a picture that a jury will believe, understand, and feel sympathetic towards.
You don't want to look like you are stuck-up or going after the doctor because you didn't get the results that you wanted. You want to look like a sympathetic and you want people to feel for you and for what you have been through. It is up to your attorney to tell this story and to get the jury on your side.
Your attorney needs to be able to explain the medical side of your case in a way that the jury will understand. They need to break down the technical terms that are going to be presented in the case and make sure that all the information can be broken down into pieces that the jury can grasp and comprehend. The better the jury understands the information being presented, the more likely they are going to side with you.
If you are pursuing a medical malpractice case, you need to be able to clearly show that the doctor didn't just provide poor care, but that they were negligent in the care that they provided you with. You also need an attorney who will explain and present your case in a way that the jury will understand and identify with. These are the two keys to winning your medical malpractice case.
